Our emergency services client was involved in an incident when their vehicle was proceeding at speed along a main country road at night, with lights and sirens activated under emergency call conditions.
The situation
A third-party vehicle pulled out from a junction on the right-hand side immediately in front of our client’s vehicle. In order to avoid a serious collision, our client’s driver took emergency action and swerved to the left. In doing so, their vehicle left the road and overturned on the verge and the third-party driver fled the scene.
Although the incident was caught on our client’s dashcam footage, the third party vehicle registration was unable to be made out. Our client worked with the police to share the footage via media outlets in efforts to identify the offending vehicle or driver, however the campaigns produced no results. Our client had their vehicle repaired for £28,000 under excess, which was an uninsured loss to their organisation without a responsible party to pursue.
Can you recover damages without an identified vehicle?
Our client had almost given up on recovery prospects when they approached us tentatively for advice. We used our expertise and experience to identify a route to recovery, and suggested a claim via the Motor Insurer’s Bureau (MIB) ‘Untraced Drivers Agreement’, which we then pursued on behalf of our client.

We have previously been successful in cases where the offending vehicle registration is not identified, but we are able to otherwise evidence details of the vehicle responsible for causing the collision. Using our client’s dashcam footage which clearly identified the circumstances and a responsible third party, the claim was successfully submitted to the MIB who paid in full for £28,000 repairs and £3,000 Loss of Use.
